Appeals Court Agrees to Toss Trump Classified Docs Case

The 11th Circuit Court of Appeals has dismissed Special Counsel Jack Smith’s case against President-elect Donald Trump over retaining classified records after leaving office. The case continues for Trump’s co-defendants, Walt Nauta and Carlos de Oliveira.

Smith cited Trump’s upcoming inauguration and DOJ guidelines barring prosecution of sitting presidents. He also moved to dismiss Trump’s election meddling case. Despite hopes for an appeal, this decision ends a significant case focused on Trump’s post-White House actions. Prosecutors had charged Trump with Espionage Act violations and obstruction for refusing to return White House records.
